Terms
The contract between you and BioQuant IQ for use of the Echo website, Sprints, and related services. Governed by Swiss law.
Effective: 22 April 2026
1. Introduction
These Terms govern your use of Echo ("Service"), operated by BioQuant IQ (Manoj Kumar Mandelia, Basel, Switzerland) ("we", "us"). By using the Service you agree to these Terms.
2. Services
Echo provides behavioural leadership development via situation-based Sprints. Specific deliverables are described on your order form or in the Service’s user interface.
3. Accounts
You are responsible for keeping credentials secure. Notify us immediately of any suspected unauthorised access at privacy@bioquantiq.ch.
4. Acceptable use
No reverse engineering; no automated scraping that impairs the Service; no use of the Service for unlawful purposes; no resale without written authorisation.
5. Intellectual property
Echo, the Sprint content, the taxonomy, and related materials are owned by BioQuant IQ. You retain ownership of your own inputs. You grant us a limited licence to process your inputs solely to operate the Service.
6. Fees
Fees are stated in Swiss Francs on your order form. VAT is added where applicable. Late payment accrues interest at the Swiss statutory rate.
7. Availability
We target 99.5% monthly availability, measured excluding planned maintenance announced 48 hours in advance.
8. Warranty disclaimer
The Service is provided "as is". To the extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose. Echo is a development tool, not a psychometric assessment, and not a substitute for professional advice.
9. Liability
To the maximum extent permitted by law, our aggregate liability under these Terms is capped at the greater of (a) CHF 500, or (b) the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses.
10. Indemnity
You will indemnify us against third-party claims arising from your breach of Section 4 (Acceptable use) or your unlawful use of outputs.
11. Termination
Either party may terminate for material breach with 30 days’ written notice if the breach is not cured. On termination, we provide a 30-day export window.
12. Governing law
Swiss substantive law, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.
13. Disputes
Exclusive jurisdiction: the ordinary courts of the Canton of Basel, subject to mandatory consumer-protection rules.
14. Miscellaneous
If any clause is unenforceable, the rest remains in force. These Terms are the entire agreement for the Service, superseding prior versions. We may update them with 30 days’ notice.
